Chapter I General Provisions

Article 1 Application These Terms of Use (hereinafter referred to as the "Terms") apply to "Lulu Pilates Studio" (hereinafter referred to as the "Facility").

Article 2 Operating Entity The Facility will be operated and managed by BOLD HORIZONS Inc. (hereinafter referred to as "the Company").

Article 3 Purpose The purpose of this facility is to promote the mental and physical health of its members through their use, as well as to foster friendship among its members, and to contribute to the creation of a rich and healthy community in the local area.

Chapter 2 Members

Article 4 Membership System (1) This facility is a members-only facility.
(2) Anyone who wishes to join the Facility will be granted membership by completing an application process, receiving approval from the Company, and entering into various contracts, including the membership terms and conditions, in order to be able to use the Facility's facilities.

Article 5 Reservation System In order to ensure the safety and smooth use of the facility, reservations are required in principle. Reservation times and reservation methods will be determined separately.

Article 6 Membership Qualifications (1) Membership of this facility is limited to those who meet all of the following criteria.
① Those who are 16 years of age or older and have Japanese nationality or reside in Japan. ② Those who agree with the purpose of this facility and can abide by these terms and conditions and other rules regarding operation and management established by our company.
3) Those who are in good health and have not been advised by a doctor to exercise. (Pregnant women cannot join during pregnancy.)
4) Those who are free of heart disease, high blood pressure, skin diseases, infectious diseases, mental illnesses and similar diseases.
⑤ Those who have been determined, based on reasonable grounds, to have no problems using the facilities through counseling and medical checks provided by the facility.
⑥ The person and/or their family members are not members of an organized crime group, a member of an organized crime group, a group related to a crime, a right-wing group claiming to be an organized crime group, or other anti-social forces as defined in Article 38 (hereinafter referred to as "anti-social forces, etc."), and do not represent themselves as such.
⑦ Those who do not possess or use illegal drugs⑧ Those who do not bring in dangerous items such as knives or gunpowder⑨ Those who do not use the facility while under the influence of alcohol⑩ Those who have the appropriate social common sense for using the facility⑪ Those who have never been expelled or otherwise punished from this facility or any other facility operated by our company. (2) If any of the requirements in the previous paragraph are violated, your membership may be terminated.

Chapter 3 Pass Use

Article 19 Nature of the Pass The pass issued by the Studio (hereinafter referred to as the "Pass") confers special rights that can only be used by the purchaser.

Article 20. Prohibition of Transfer Transferring, lending, or selling this Pass to a third party is strictly prohibited.

Article 21 No Refunds No refunds will be given for purchased passes, regardless of the reason.

Article 22. Extension of Validity Period In principle, extension of the validity period of a Pass will not be permitted.

Article 23 Exceptions No exceptions will be made to Articles 20 to 22 unless otherwise approved by the Company.

Article 24 Changes to Terms and Conditions We reserve the right to change these terms and conditions as necessary. The changed terms and conditions will come into effect when they are announced on our website.

If you do not agree to these terms, please refrain from purchasing a pass. By purchasing a pass, you are deemed to have agreed to these terms.

Chapter 4 Management

(Articles 25 to 30 remain unchanged)

Article 31 Closing Days and Restrictions on Use, etc. (1) The Facility may close all or part of the Facility or restrict its use in any of the following cases:
① When inspecting, repairing or renovating the facility; ② When laws and regulations are enacted, amended or abolished, administrative guidance is given, a significant change in social conditions is caused, or other unavoidable circumstances occur; ③ When it is predicted that the operation of the facility is difficult or dangerous due to weather, disaster, sudden accident, or other unavoidable reasons; ④ When remodeling, expanding, renovating, repairing, maintaining or inspecting the facility; ⑤ When there are reasonable grounds for making a judgment. (2) In the cases of the preceding paragraph, except as provided for by law or when the Company deems it necessary, the obligation to pay membership fees etc. borne by the Member will not be reduced or exempted.
(3) The facility will be closed from December 30th to January 3rd each year. Other closing days will be determined separately.

Article 37 Ownership of Rights All intellectual property rights relating to the Facility belong to our company or to those who have granted licenses to our company, and the license to use the Facility based on these Terms and Conditions does not imply any license to use the intellectual property rights relating to the Facility that belong to our company or those who have granted licenses to our company.

Article 38 Exclusion of Antisocial Forces (1) Members shall undertake to ensure that they are not, and will not be, associated with antisocial forces.
(2) If we determine that a member is a member of an anti-social force, etc., we may cancel the member's membership without prior notice to the member.
(3) If we cancel a membership pursuant to the provisions of the preceding paragraph, we shall not be liable for any damage suffered by the member.

Article 39 Governing Law The establishment, effect, performance and interpretation of these Terms and Conditions shall be governed by the laws of Japan.

Article 40 Jurisdiction If a dispute arises regarding these Terms and Conditions, the Tokyo District Court shall be the exclusive court of first instance.

Supplementary Provision: These terms and conditions will be effective from August 1, 2024.

株式会社BOLD HORIZONS（以下「当社」と言います）は、本ウェブサイト上および「ルルピラティススタジオ／Lulu PILATES STUDIO」で提供するサービス（以下「本サービス」と言います）における個人情報の取扱いについて、以下のとおりプライバシーポリシー（以下「本ポリシー」と言います）を定め、個人情報の保護に関する法律および関連法規に従い、個人情報の保護に努めます。

第1条個人情報

（１）「個人情報」とは、個人情報保護法にいう「個人情報」を指すものとし、生存する個人に関する情報であって、当該情報に含まれる氏名、生年月日、住所、電話番号、連絡先その他の記述等により特定の個人を識別できる情報及び容貌、指紋、声紋にかかるデータ、及び健康保険証の保険者番号などの当該情報単体から特定の個人を識別できる情報（個人識別情報）を指します。

（２）「要配慮個人情報」とは、個人情報のなかで、本人の人種、信条、社会的身分、病歴、犯罪の経歴、犯罪により害を被った事実その他本人に対する不当な差別、偏見その他の不利益が生じないようにその取扱いに特に配慮を要するものとして政令で定める記述等が含まれる個人情報を指します。

（３）「履歴情報および特性情報」とは、上記に定める「個人情報」以外のものをいい、ご利用いただいたサービスやご購入いただいた商品、ご覧になったページや広告の履歴、利用者が検索された検索キーワード、ご利用日時、ご利用の方法、ご利用環境、郵便番号や性別、職業、年齢、利用者のIPアドレス、クッキー情報、位置情報、端末の個体識別情報などを指します。

第２条個人情報の収集

当社は、利用者がスタジオの利用登録をする際に氏名、生年月日、住所、電話番号、メールアドレス、銀行口座番号、クレジットカード番号、運転免許証番号などの個人情報を収集することがあります。また、利用者と提携先などとの間でなされた利用者の個人情報を含む取引記録や、決済に関する情報を当社の提携先（情報提供元、広告主、広告配信先などを含みます。以下、｢提携先｣といいます。）などから収集することがあります。

利用者がスタジオの利用登録をする際に、病歴や怪我の履歴など要配慮個人情報を収集する場合には必ず本人の同意のもとに取得します。

4. 第三者への提供

当社は、保有する個人情報を、法令により認められている場合を除き、お客様の同意なくいかなる第三者にも提供または開示いたしません。

第３条個人情報集を収集·利用する目的

当社が「個人情報」と「履歴情報および特性情報」を収集・利用する目的は、以下のとおりです。

①当社サービスの提供・運営のため

②利用者からのお問い合わせに回答するため（本人確認を行うことを含む）

③利用者が利用中のサービスの新機能、更新情報、キャンペーン等及び当社が提供する他のサービスの案内のメールを送付するため

④メンテナンス、重要なお知らせなど必要に応じたご連絡のため

⑤利用規約に違反した利用者や、不正・不当な目的でサービスを利用しようとする利用者の特定をし、ご利用をお断りするため　

⑥利用者にご自身の登録情報の閲覧や変更、削除、ご利用状況の閲覧を行っていただくため

⑦有料サービスにおいて、利用者に利用料金を請求するため

⑧上記の利用目的に付随する目的

⑨当社のHPその他当社が管理する広告媒体において、当社の商品の広告をさせていただくため

第４条（利用目的の変更）

当社は、利用目的が変更前と関連性を有すると合理的に認められる場合に限り、個人情報の利用目的を変更するものとします。

利用目的の変更を行った場合には、変更後の目的について、当社所定の方法により、利用者に通知し、または本ウェブサイト上に公表するものとします。

第５条個人情報の第三者提供

（１）当社は、次に掲げる場合を除いて、あらかじめ利用者の同意を得ることなく、第三者に個人情報を提供することはありません。ただし、個人情報保護法その他の法令で認められる場合を除きます。

①人の生命、身体または財産の保護のために必要がある場合であって、本人の同意を得ることが困難であるとき

②公衆衛生の向上または児童の健全な育成の推進のために特に必要がある場合であって、本人の同意を得ることが困難であるとき

③国の機関もしくは地方公共団体またはその委託を受けた者が法令の定める事務を遂行することに対して協力する必要がある場合であって、本人の同意を得ることにより当該事務の遂行に支障を及ぼすおそれがあるとき

④予め次の事項を告知あるいは公表し、かつ当社が個人情報保護委員会に届出をしたとき

（２）前項の定めにかかわらず、次に掲げる場合には、当該情報の提供先は第三者に該当しないものとします。

①当社が利用目的の達成に必要な範囲内において個人情報の取扱いの全部または一部を委託する場合

②合併その他の事由による事業の承継に伴って個人情報が提供される場合

③個人情報を特定の者との間で共同して利用する場合であって、その旨並びに共同して利用される個人情報の項目、共同して利用する者の範囲、利用する者の利用目的および当該個人情報の管理について責任を有する者の氏名または名称について、あらかじめ本人に通知し、または本人が容易に知り得る状態に置いた場合

第６条（個人情報の開示）

（１）当社は、本人から個人情報の開示を求められたときは、本人に対し、遅滞なくこれを開示します。ただし、開示することにより次のいずれかに該当する場合は、その全部または一部を開示しないこともあり、開示しない決定をした場合には、その旨を遅滞なく通知します。

①本人または第三者の生命、身体、財産その他の権利利益を害するおそれがある場合

②当社の業務の適正な実施に著しい支障を及ぼすおそれがある場合

③その他法令に違反することとなる場合

（２）前項の定めにかかわらず、履歴情報および特性情報などの個人情報以外の情報については、原則として開示いたしません。

第７条（個人情報の訂正および削除）

（１）利用者は、当社の保有する自己の個人情報が誤った情報である場合には、当社が定める手続きにより、当社に対して個人情報の訂正、追加または削除（以下、「訂正等」といいます。）を請求することができます。

（２）当社は、利用者から前項の請求を受けてその請求に応じる必要があると判断した場合には、遅滞なく、当該個人情報の訂正等を行うものとします。

（３）当社は、前項の規定に基づき訂正等を行った場合、または訂正等を行わない旨の決定をしたときは遅滞なく、これを利用者に通知します。

第８条（個人情報の利用停止等）

（１）当社は、本人から、個人情報が、利用目的の範囲を超えて取り扱われているという理由、または不正の手段により取得されたものであるという理由により、その利用の停止または消去（以下、「利用停止等」といいます。）を求められた場合には、遅滞なく必要な調査を行います。

（２）前項の調査結果に基づき、その請求に応じる必要があると判断した場合には、遅滞なく、当該個人情報の利用停止等を行います。

（３）当社は、前項の規定に基づき利用停止等を行った場合、または利用停止等を行わない旨の決定をしたときは、遅滞なく、これを利用者に通知します。

（４）前２項にかかわらず、利用停止等に多額の費用を有する場合その他利用停止等を行うことが困難な場合であって、利用者の権利利益を保護するために必要なこれに代わるべき措置をとれる場合は、この代替策を講じるものとします。

第９条（アクセス解析について）

当社では、当サイトの利用状況及び広告効果等の情報を解析するため、以下の情報収集モジュールが組み込まれています。これに伴い、当社は、以下の情報収集モジュールの提供者に対しユーザー情報の提供を行う場合があります。これらの情報収集モジュールは、個人を特定する情報を含むことなくユーザー情報を収集し、収集された情報は、各情報収集モジュール提供者の定めるプライバシーポリシーその他の規定に基づき管理されます。また、提供者による情報の使用は、各提供者のオプトアウトページにより無効にすることができます。
